EU Supply Chain Due Diligence Regulations

The Corporate Sustainability Due Diligence Directive (expected adoption in 2024) follows several national legislations (such as the French Corporate Duty of Vigilance Law and the German Supply Chain Due Diligence Act, which came into force, respectively, on 01.01.2020 and 01.01.2023) that make it mandatory for companies in the EU to uphold human rights and environmental standards in their entire supply chain. 

Companies will need to conduct a risk analysis as part of the due diligence process for the whole supply chain, thereby constructing preventive measures as well as remedial actions when violations are identified.

EU Anti-Greenwashing Regulations

A new EU Directive (expected adoption by end-2023 at the earliest) will amend the Unfair Commercial Practices Directive and the Consumer Rights Directive to protect consumers against misleading claims about a product’s environmental and social impact, durability, and reparability. 

Companies will no longer be able to make generic claims that cannot be backed up by evidence and verified by an objective and independent monitoring system.

USA – UFLPA

The Uyghur Forced Labor Protection Act (adopted on 21.06.2022) obliges companies wanting to import cotton to the United States to supply evidence to the US Customs and Border Patrol (CBP) that those products were not made with forced labour.

When requested by CBP, importers should be able to trace the complete supply chain of the goods under review and demonstrate that imported goods were not mined, produced, or manufactured in Xinjiang. An official report to the congress of the U.S. Department of Homeland Security (DHS) states that DNA traceability or isotopic testing can be used for the purpose of proving the origin of particular goods or materials.
